1. Acceptance of Terms

By accessing and using Byvano (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Byvano provides a platform that enables Shopify merchants to import social media videos, tag products, and display shoppable video widgets on their online stores.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Content & Intellectual Property

You retain ownership of your content. By using the Service, you grant us a limited license to display your videos and product information as necessary to provide the Service.

5. Billing & Cancellation

Paid plans are billed monthly or yearly through Shopify Billing or Stripe. You may cancel your subscription at any time from your dashboard.

7. Limitation of Liability

To the maximum extent permitted by law, Byvano and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business interruption, arising out of or related to your use of the Service.

8. Indemnification

You agree to defend, indemnify, and hold harmless Byvano, its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

9. Dispute Resolution

If a dispute arises, both parties agree to first attempt to resolve it informally by written notice. If unresolved after 30 days, disputes will be resolved through binding arbitration, except where prohibited by applicable law or where injunctive relief is sought for intellectual property misuse.

10. Governing Law

These Terms are governed by and construed under the laws of the State of Texas, United States, without regard to conflict of law principles. Subject to arbitration terms above, courts located in Texas will have exclusive jurisdiction.
